These Terms & Conditions ("Terms") govern your use of the barthirtyfive.com website ("Site") operated by Bar Thirty Five ("we", "us", "our"), a licensed bar trading from 35 Belle Vue, Bude, Cornwall, EX23 8LF, United Kingdom. By accessing the Site you agree to these Terms. If you do not agree, please do not use the Site.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property. All source code, website design, photographs, graphics, videos, trademarks and logos on the Site are owned by or licensed to us and protected under the Copyright, Designs and Patents Act 1988 and applicable UK intellectual property laws.

You may not use the Site to scrape data, circumvent security features, harvest email addresses, submit false information, impersonate another person, or upload malicious code to our form endpoints or servers.

We reserve the right (but are not obliged) to monitor the Site, remove content that in our sole judgement violates these Terms, and take legal action where appropriate. We may update, suspend or discontinue the Site at any time without notice.

6. Licensing & Age Verification (Challenge 25)

Bar Thirty Five operates under a Premises Licence issued by Cornwall Council in accordance with the Licensing Act 2003. The sale of alcohol to anyone under the age of 18 is strictly prohibited.

We operate a Challenge 25 policy. If you appear under 25 you will be asked to present valid photographic ID (passport, UK photo driving licence, or PASS-accredited proof-of-age card) before being served alcohol. Any person unable to provide proof of age will not be served.

The website and its content are not directed at persons under 18. Promotional content such as happy hour offers is intended for over-18s only.

7. Liability

Nothing in these Terms limits or excludes our liability for (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, (c) any other liability which cannot lawfully be excluded.

Subject to the above, we provide the Site "as is" and make no express or implied warranty regarding the accuracy or availability of information on the Site. Our liability for losses caused by reasonably foreseeable breach is limited as far as permitted by law. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

8. Your Consumer Rights

As a UK consumer you have statutory rights under the Consumer Rights Act 2015 and the Digital Markets, Competition and Consumers Act 2024. Goods and services supplied by us in our venue must be of satisfactory quality, fit for purpose and match their description. Nothing in these Terms affects those rights.

If you are unhappy with your experience at the venue or with our website, please contact us first so we can put things right. You can reach us by phone, email, or in person:

If we cannot resolve your complaint, you may contact Cornwall Council's Licensing team (the relevant licensing authority) or Citizens Advice on 0808 223 1133 for consumer guidance. Data-protection complaints can be raised with the Information Commissioner's Office at ico.org.uk.

10. Governing Law

These Terms are governed by the laws of England and Wales and any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
